Asmongold filed a motion to dismiss the lawsuit against Mizkif

An ongoing legal battle between the two Twitch streamers has reached a new stage as Zack “Asmongold” Hoyt filed a motion to dismiss the defamation lawsuit against him and Emily Beth “Emiru” Schunk filed by Matthew “Mizkif” Rinaudo. As of this writing, the case remains an ongoing matter between all Twitch content creators and the organizations involved.

Both Asmongold and Mizkif are co-founders of One True King (OTK), an Austin-based media organization that also includes Emiru, who has served as a co-owner since 2023. In October 2025, Emiru revealed during a live broadcast that she was previously in a relationship with Mizkif, although the relationship ended several months ago. However, Emiru accused Mizkit of sexually assaulting and blackmailing her during some vulnerable moments, claiming he took advantage of her. After Emir's accusations, OTK said that Mizkif's contract with the organization was terminated some time in advance and more than a million shares of the company were acquired.

In response to the allegations, Mizkif filed a lawsuit against Emir and Asmongold in November 2025 for defamation and monetary damages resulting from his termination from OTK. But according to a motion filed under Federal Rule of Civil Procedure 12(b)(6) in the U.S. District Court for the Western District of Texas, Asmongold's legal team wants the court to dismiss Mizkif's lawsuit with prejudice. The defense argued that Mizkif did not state any valid claims against the defendants. In addition, Asmongold's lawyers said any public comment about Mizkif or his actions is not grounds for any legal action by the plaintiff. As an alternative to dismissing the case, Asmongold's legal team said Mizkif and his lawyers could provide a more definitive statement that clearly identifies any defamatory comments made by the defendants against Mizkif.

Asmongold's lawyers argued that Mizkif had not disclosed that he was a public figure, arguing that “nothing he's upset about is actionable.” Although Asmongold resigned from OTK in 2024, this did not stop him from sharing his comments on topics concerning current and former members of the organization on his streams. Asmongold's legal defense also said that Mizkif admitted to slamming doors in an act of aggression and taking steroids, which caused him “crazy anger issues” as a result. The defense argued that any comment on statements Mizkif made publicly did not constitute defamation under Texas state law. Asmongold's legal team said, “Mizkif cannot sue Hoyt for defamation for merely repeating and agreeing with some of Mizkif's own statements.”

The defense added that any statements Mizkif objected to were opinions that are protected under the First Amendment. Due to Asmongold's reputation as a world leader in content creation, he is also considered a public figure. Asmongold's defense team said Mizkif must prove actual malice in his defamation claim, rather than relying on any comments on his confession. However, the deposition filed by Asmongold's lawyers is limited. It only covers what was levied against Asmongold by Mizkif and not what was levied against Emir or OTK. As of this writing, the U.S. District Court in Austin has not ruled in favor of Asmongold or Mizkif. As the case is still open, it remains to be seen what impact any decision will have.

However, Mizkif's legal troubles are unlikely to end anytime soon. After Emir aired in October, more women accused Mizkif of sexual harassment, abuse and running smear campaigns against them. After OTK revealed Mizkif's termination, Mizkif left Twitch and started streaming on Kick, one of his main competitors.
